ORDER: * Each order implies the acceptance by the purchaser of our sales conditions. * Each order is considered as accepted and confirmed "after approval of our salesdepartement". Any cancellation can be accepted only if communication of it is given within 24hours from the receipt of the order. * Each item is packed in the quantities stated on our pricelist * In case of ordered quantities not corresponding to our standard packages, they will automatically be rouded up to the next undivided pack
CURRENCY and PRICES: * All listed unit prices are expressed in Euro. They are to be considered net of taxes and valid until the expressed validation date upon the pricelist. It is the purchasers duty to check the validity of the pricelist. * Quoted prices are to be considered ex-works Zevenaar NL.
DELIVERY TERMS: * Agreed delivery terms are to be considered as binding. Possible delays occuring because of unforeseen circumstances beyond our control cannot cause any order cancellation, nor any penalty. * It is the duty of the purchaser to carefully check the goods when arrived and dispute damages or lacks directly to the Driver/Forwarder making written reserve on the delivery note.Claims for damage or any other discrepancies must be reported within 7 days of receipt of goods. * Release of goods can only take place when paid to the full in advance.
RETURNS: * As a general rule, items deliverd in accordance with the confirmed order, will not be accepted back, nor substituted. Any return can take place only after the approval of our company. In case of approval, goods will be returned carriage free, in perfect conditions and packed in the original packaging. The credit note will be issue considering possible falls in value.
RETENTION of TITLE: * All delivered goods remain property of EXIVE company until total payment of them is received from purchaser. The purchaser is allowed to sell them provided he is aware that they are subject to a clause of retention and that the first seller can claim their payment or property, in case the corresponding amount is not paid at maturity.
JURISDICTION: * The court of Arnhem shal have exclusive jurisdiction over any disputes relating to the terms and conditions mentioned above
